These Terms govern the professional cinematographic equipment rental service provided by Maya Rent. Please contact us to receive the complete rental agreement before each rental. By using our services, you accept these Rental Terms and Conditions.

Article 1 – Subject Matter of the Agreement

Lessor: Maya Rent di Jose Jimenez rents technical equipment for film productions under the terms agreed upon and specified in the Equipment Description Form (Annex 1).

Exclusive Use: The equipment shall be used exclusively for the agreed film production. Any other use is prohibited.

Professional Use: The Lessee declares that they are acting in the course of their professional activity. Consumer protection legislation (Italian Legislative Decree No. 206/2005) does not apply to this contractual relationship.

Article 2 – Rental Term, Fees, and Payment

The rental fee, duration, and pickup/return dates shall be established for each rental.

Payment of the full amount must be made before or at the time of collection via bank transfer:

In the event of late payment, default interest shall automatically accrue pursuant to Italian Legislative Decree No. 231/2002, without the need for formal notice.

Failure to pay for more than seven (7) days authorizes Maya Rent to suspend future deliveries and invoke the express termination clause.

The Lessee may not suspend or delay payments due to disputes concerning contract performance (solve et repete clause pursuant to Article 1462 of the Italian Civil Code), except in cases involving contract nullity or annulment.

Where outstanding payments exist, including under previous agreements, Maya Rent may refuse new rentals until all amounts due are fully paid.

The amounts indicated in the contract, invoices, and annexes constitute a certain, liquid, and enforceable debt (Article 1988 of the Italian Civil Code) and may serve as grounds for summary debt collection proceedings.

Article 3 – Delivery, Return, and Inspection

The equipment shall be delivered at:

upon execution of the Equipment Description Form.

The equipment must be returned by 11:00 AM on the agreed return date at the same location. Partial returns are not permitted.

In the event of late return, the Lessee shall pay the agreed daily rental fee plus an agreed contractual penalty for each day or fraction thereof of delay (Article 1382 of the Italian Civil Code).

Maya Rent shall perform a functional inspection within twenty-four (24) business hours after return. Acceptance of the returned equipment does not constitute a waiver of defects not immediately detectable.

Early return of the equipment shall not entitle the Lessee to any refund unless otherwise agreed in writing.

Maya Rent undertakes to deliver tested equipment ready for use. Rechargeable batteries are supplied fully charged. Maya Rent accepts no responsibility for loss of charge due to travel or temperature variations.

Article 4 – Booking Cancellation

The Lessee may cancel the rental without penalty only by written notice sent at least forty-eight (48) hours before the scheduled pickup or delivery time.

If cancellation is communicated between forty-eight (48) and twenty-four (24) hours before the scheduled pickup or delivery, Maya Rent shall apply a penalty equal to fifty percent (50%) of the total rental fee.

If cancellation is communicated less than twenty-four (24) hours before the scheduled pickup or delivery, or if the equipment is not collected without prior written notice, Maya Rent shall apply a penalty equal to one hundred percent (100%) of the total rental fee.

The security deposit is excluded from the penalty calculation. Any excess amounts paid shall be refunded to the Lessee.

Article 5 – Lessee’s Liability

Full Liability

The Lessee assumes full civil, criminal, and financial responsibility for the equipment from delivery until accepted return.

The Lessee is liable for deterioration, damage, loss, theft, destruction, misuse, and violations of safety regulations, including accessories, cables, and packaging.

Sub-renting or transferring the equipment to third parties without Maya Rent's written authorization is strictly prohibited.

Proper Custody

The Lessee shall store the equipment in secure locations inaccessible to the public and shall exercise the care appropriate for high-value assets.

Leaving equipment unattended in vehicles parked on public roads is prohibited.

Any technical intervention, modification, or repair may only be performed by Maya Rent or service centers designated by Maya Rent in writing.

Theft, Loss, or Fire

Accepted payment method: SEPA Bank Transfer.

In the event of theft, loss, or fire, the Lessee shall:

File a police report within twenty-four (24) hours;
Send a copy of the report to Maya Rent within the same period;
Reimburse the replacement value of the equipment based on the manufacturer's or authorized dealer's current price list;
Reimburse any substitute rental costs and documented consequential damages.

Article 6 – Security Deposit and Insurance

Upon delivery, the Lessee shall pay a security deposit equal to thirty percent (30%) of the total value of the equipment listed in Annex 1.

The deposit secures all contractual obligations and shall be refunded within five (5) business days after return of the equipment, less any applicable deductions.

For rentals exceeding €2,000, “All Risks” insurance coverage in favor of Maya Rent is mandatory through either:

Option 1 – Maya Rent Chubb European Group SE Policy

Premium: 0.198% of the insured value for Italy/EU rentals;
Premium: 0.396% for non-EU countries;
Minimum premium: €10.00 per project.

Option 2 – Lessee’s Own Insurance Policy

The Lessee may provide an “All Risks” insurance policy naming Maya Rent as beneficiary and loss payee, with adequate limits and deductibles not exceeding 10% of the insured value.

For rentals up to €2,000, insurance coverage is optional but strongly recommended.

The policy covers only direct physical damage to the rented equipment. Liability toward third parties, production downtime, loss of profit, and worker injuries are excluded.

Article 7 – Breakdowns, Malfunctions, and Technical Interventions

Immediate Notification

In the event of a breakdown or malfunction, the Lessee must immediately cease use of the equipment and notify Maya Rent in writing within twelve (12) hours of becoming aware of the issue.

Tampering Prohibition

Opening, disassembling, modifying, or repairing the equipment by anyone other than Maya Rent or authorized service centers designated in writing is strictly prohibited.

Repair Costs

If the malfunction results from misuse, negligence, lack of skill, or failure to follow the manufacturer’s instructions, all diagnosis, repair, transport, downtime, and replacement costs shall be borne exclusively by the Lessee.

Compliance with Instructions

The Lessee must follow Maya Rent’s instructions regarding shipment of the equipment to an authorized service center or replacement procedures.

Article 8 – Early Termination

Maya Rent may terminate this agreement with immediate effect by simple written notice (PEC, email, or letter) upon the occurrence of any one of the following events:

Payment delay exceeding seven (7) days after the due date;
Failure to obtain mandatory insurance coverage for rentals exceeding €2,000.00;
Failure to return the equipment on the agreed date;
Violation of the prohibition against sub-rental;
Misuse of the equipment or violation of safety regulations;
The Lessee becoming subject to insolvency proceedings (bankruptcy, arrangement with creditors, liquidation).

Consequences of Termination

The Lessee shall:

Forfeit all amounts already paid, which shall be retained as a minimum contractual penalty;
Pay a penalty equal to twenty percent (20%) of the remaining rental fees due until the original expiration date (Article 1382 of the Italian Civil Code), regardless of proof of damages;
Immediately return the equipment. Maya Rent may access the premises through appointed representatives to recover the equipment.

The parties agree that this penalty is fair and proportionate and waive, to the extent permitted by law, any right to seek judicial reduction of the penalty.

Article 9 – Governing Law and Jurisdiction

This Agreement shall be governed by Italian law.

Any dispute arising out of or relating to this Agreement, including disputes concerning its validity, interpretation, performance, or termination, shall be subject exclusively to the jurisdiction of the Courts of Bologna, Italy, to the exclusion of any other competing jurisdiction.
